RULES AND REGULATIONS
1. Perpetual Care
a) The cost of an interment space includes perpetual care.
b) Perpetual care does not include the maintenance of grave markers or monuments.
c) For perpetual care purposes, no permanent fencing of any kind is permitted except for those which exist prior to March 30, 2022.
2. Grave Site Ownership
a) An interment space shall not be used for any purpose except as a place of burial for human bodies or cremains.
b) An interment space shall not be sold or conveyed to any person, or persons without the written consent of the Board. The Board must receive written notice prior to the transfer or sale of an interment space.
c) To sell or transfer an interment space, a new deed must be obtainedfrom the Secretary, so the records of the cemetery remain accurate.
d) Any resale or transfer of an interment space will require a deed transfer fee as set forth in the latest Fee Schedule to be paid to the Union Cemetery Association of Lebanon, N.J. An interment space may be returned to the Association at a price agreed upon by the Board.
3. Grave Site
a) Each casket must be enclosed in a concrete vault.
b) The Board reserves the exclusive right to do all grading, landscaping, excavating, marking of an interment or disinterment, including all openings, filling and closing of an interment space.
c) Any interment or disinterment must be arranged through, and supervised by, the Board or some other person authorized by the Board. A reasonable fee may be charged for such supervision.
d) No disinterment will be permitted except with the consent of the persons required by the N.J. Cemetery Act.
e) The Board shall not be held responsible for any error resulting from an order for interment or disinterment.
4. Monuments and Markers
a) The Board must be notified prior to the installation of any marker or monument.
b) All persons wishing to do any work in the cemetery including but not limited to erecting monuments, grave markers or cutting any inscriptions must first present to the Board a written authorization signed by the owner, heir or authorized representative of the interment space. Any proposed work must be under the supervision of the Board, or some other person authorized by the Board. A reasonable fee may be charged for such supervision.
c) All grave markers or monuments must be within the confines of the interment space and include a foundation. The Board will arrange for the installation of all foundations. An installation fee, as set forth in the latest Fee Schedule, must be paid to the Union Cemetery Association of Lebanon, N.J. prior to the installation of all foundations. Accordingly, prior to installation of any marker or monument, a layout, including measurements, must be presented to the Board for approval.
d) No setting of markers or monuments will be permitted during inclement weather, the same to be determined at the sole discretion of the Board.
e) When a monument or marker shall need repair, the Board may make the repairs at the expense of the owner.
f) Owners wishing to define the boundaries of their interment space, may do so with corner markers set at ground level.
g) At the discretion of the Board, any person or business causing destruction or damage to property or cemetery grounds, will be charged the amount to replace or repair such act.
5. Grave Site Decoration
a) There shall be no fences, borders, trees, benches, planters, bushes, shrubbery, flower mounds or any hardscape items; there shall be no raised plots nor cut paths.
b) Live or artificial plants are to be placed within 10 inches from the front of the monument or marker.
c) Cut flowers will be removed two weeks after a holiday or funeral. Christmas decorations by February 20th or as weather permits.
d) If a pre-existing bush, ornamental item or plant in any interment space shall become unsightly, detrimental or impedes the ability to mow or trim the grass or creates a safety concern, the Board will decide if the same shall be removed without notice.
e) If any tree, shrub or plant becomes detrimental to the interment space upon which it stands or to any adjacent interment space, paths, roadways, utility systems, or for any reason its removal is deemed necessary, the Board shall have the right to remove such item, or any part thereof, or otherwise remedy the existing conditions, in the Board’s judgement, it deems best. The Board shall have no obligation to replace such item, even if it was purchased as a memorial.
6. General
a) Pets are not permitted on cemetery grounds.
b) No advertising will be permitted in any form on any work in the cemetery.
c) Masons, stone cutters or other workers or their employees, not in the employ of the Board, will be responsible for any damage caused to roadways, paths, grave sites, or monuments.
d) Special cases may arise in which literal enforcement of a rule or regulation may impose unnecessary hardship. The Board therefore reserves the right at any time with or without notice to anyone to revise, amend, supplement, or make exceptions to these rules and regulations. Such exceptions shall in no way be construed as affecting the general application of such rules and regulations.
